Request for independent and impartial benches of judges in the Manipur High
Court in the conflict cases – Regd.
Lordship,
As you know there has been a long standing and
unfortunate dispute between the Meitei’s and Kuki’s in the State of Manipur
which erupted in long standing conflict where properties were destroyed and
many tribals killed. Some of these cases are pending before the High Court at
Manipur.
With a heavy heart we write this letter after
experiencing a certain imbalance in the allocation of judges for the benches
dealing with the Kuki cases. We hesitated to write this letter in the fear that
it may be understood wrongly. However, now we are compelled to communicate to
you because in case after case justices from the Meitei community are on the
benches of the High Court dealing with highly contentious matters regarding the
two communities, and justice is not being delivered.
If justice must not only be done but must be
seen to be done as well, from our community we feel that it would be impossible
to get justice if judges from the Meitei community are constantly dealing with
legal matters relating to the conflict between the Meitei’s and Kuki’s. We have
seen this in cases and therefore we now write with the request that in cases
relating to the tribals no Meitei or Kuki judge should be on the bench, rather
since there are judges are available who are neither Meitei’s nor Kuki’s or
sentiments and experiences may be respected.
Kindly direct and take into consideration and
ensure that judges who are neither Meitei nor Kuki be assigned our cases in the
High Court as well as the Lower Courts.
