Gang of four: the men convicted for December 16 Delhi gang-rape

New Delhi, Sep 10, 2013 [AFP/ Hindustan Times] --- The four men convicted on Tuesday over the December 16 New Delhi gang-rape lived in and around Ram Dass Camp, an unauthorised slum in the south of the Delhi favoured by hundreds of labourers.

Residents there complain of the ignominy of being associated with the men, particularly the ringleaders whom they remember as heavy-drinking troublemakers known for their abusive language and disregard for neighbours.

Ram Singh, the regular driver of the bus used for the attack and one of the main instigators of the crime, was found hanging in his prison cell in maximum-security Tihar jail on March 12 in a suspected suicide.

The 32-year-old had confessed privately to his role, according to his parents, but during the trial he had denied the long list of charges including murder, rape and kidnapping.

Here are profiles of the four men convicted, as well as the fifth under-age suspect who was sentenced to three years in a correctional facility on August 31.

Mukesh Singh
The brother of Ram Singh who migrated to New Delhi from his ancestral village in the western desert state of Rajasthan. He frequently worked with his brother on the bus and also tried getting a job with a construction company in Delhi.

During court proceedings in April, the unmarried labourer, who has a tattoo of two swords signifying "bravery" on his left arm, told AFP he was a "very hard working man" and wanted to "lead a simple life".

Aged 29 at the time of the crime, he denied the charges against him and told the court that he "respected women".

Vinay Sharma
Aged 20 at the time of the crime, he denied being on the bus. He earned $100 a month as a helper at a local gym and lived in the same neighbourhood as Mukesh and Ram Singh.

He had completed his schooling, unlike the other convicts who are school dropouts, and during the trial said he wanted to appear for a recruitment test for a job with the Indian Air Force.

Sharma submitted an application to the judge to be moved out of Tihar jail after being assaulted by inmates. He suffered a fractured left hand while in custody.

Pawan Gupta
The youngest of the rapists, aged 19, Gupta was a fruitseller who also worked as labourer on roads and construction sites for a couple of dollars a day. During wedding season, he would work with a catering company.

He was arrested at the Ram Dass Camp where he lived with his cousin and was known as a friend of Ram Singh.

Akshay Thakur
A married father of a two-year-old son, Thakur also worked as a helper with Ram Singh and had earlier been employed in a local liquor factory and in a brick kiln.

Aged 28 at the time of the crime, he fled from Delhi on December 17, but was arrested at his father-in-law's home in the eastern state of Bihar. His wife, Punita Devi, told the police, that if her husband is found guilty then he should be "shot dead".

A juvenile
A 17-year-old at the time of the attack, who cannot be named for legal reasons, is a run-away who fled his home in impoverished Uttar Pradesh state at the age of 11.

His mother told the police that he was the eldest of her six children and that she had no contact with him during his time in the capital where he had no fixed job or address and often slept rough.

He cleaned Ram Singh's bus and in winter slept inside the vehicle.

Delhi Rape Case: 2nd accused nabbed in Bihar

New Delhi, April 22, 2013 [PTI] --- The second suspect in the brutal rape of a five-year-old girl here a week ago was arrested from Bihar early today even as protests continued while police barricaded streets near Parliament to prevent December-like anti-rape protests. 

Investigators tracked down the second suspect Pradeep, who was named by first accused Manoj Kumar, from his maternal uncle's home in Barahiya village in Bihar's Lakhisarai district late last night. 

A Delhi Police team with the help of Bihar Police Special Task Force arrested Pradeep from his uncle's residence, where he was hiding, Bihar Director General of Police Abhayanand said. 

"He will be brought to the national capital today after getting a transit remand from Darbhanga court," Delhi Police Commissioner Neeraj Kumar told PTI. 

Three Metro stations -- Race Course Road, Central Secretariat and Udyog Bhavan -- close to Parliament, India Gate and Prime Minister Manmohan Singh's residence were also closed anticipating anti-rape protests like the one witnessed in December last after the gangrape of a girl in a moving bus. 

The issue figured in the Lok Sabha with Home Minister Sushilkumar Shinde assuring agitating members that an inquiry has been ordered into alleged police lapses. 

Protests were witnessed at Parliament Gate, Police Headquarters and Jantar Mantar for the removal of Commissioner Neeraj Kumar. However, the numbers were not as large as the December protests. 

Manoj, who was arrested on Saturday from Muzaffarpur in Bihar, had told police during interrogation that one of his friends was also involved in the crime. 

The girl was raped on April 15 in a building in east Delhi's Gandhinagar locality where the victim and accused Manoj lived and she was rescued 40 hours later on April 17.

Ram Singh, prime accused in Delhi gang-raped suicide in Tihar Jail

New Delhi, Mar 11 [NDTV] --- In a huge security lapse, Ram Singh, one of the men accused in the gang-rape of a medical student in a moving bus in Delhi last December, has allegedly committed suicide at Tihar Jail, where he was lodged. His body was found in Jail Number 3 at around 5 this morning.

News agency AFP quoted prison's law officer Sunil Gupta as saying, "He tied all his clothes together and used the ceiling grille and a wooden stool to hang himself."

Who was Delhi rape accused Ram Singh? All you need to know

New Delhi, Mar 11 [firstpost.com] --- The sudden death of prime accused in the horrific 16 December Delhi gangrape Ram Singh, who committed suicide inside Tihar jail, is likely to affect the outcome of the trial say lawyers and experts. Here is a quick look at who he is and what his role in the rape was.



Prime accused in Delhi gangrape case:



Ram Singh, the driver of the bus in which the horrific gangrape was carried out, was the main accused in the case.  Singh, instead of parking the white chartered bus with its owner, had kept the vehicle with him on the night of the incident, reportedly met the other accused for dinner and then took the bus to drive around Delhi.



The group picked up the 23-year-old woman and her male friend as they were attempting to travel home after watching a film together.  The bus was driven through the bustling south Delhi areas of Munirka, Vasant Vihar and Mahipalpur as the six men raped and tortured the girl and beat her friend, using iron rods and other weapons.



According to the police report, the attack lasted at least 45 minutes.



There were six attackers, one of whom claims to be a juvenile and is being tried separately. Each of the men raped the 23-year-old woman, with at least two taking turns driving the bus. They penetrated her with two metal rods, causing such severe internal injuries that doctors later found parts of her intestines floating freely inside her abdomen.



The couple was stripped, robbed and thrown off the bus near Mahipalpur.



After fighting for her life for almost a fortnight, the 23-year-old woman breathed her last in Singapore on 29 December.



What he reportedly told the police

Singh reportedly had told the police that he had brutally assaulted the 23-year-old woman because she had resisted his attempt to rape her and bitten him.



According to police sources, Singh was drunk and he lost his cool when the girl bit him. After he was bitten he and his friends started beating the girl and her male friend with iron rods.



He had also snatched three mobile phones belonging to the girl and her friend so that they could not dial anyone for help after being thrown from the bus.



Singh had reportedly told the police that he had tried to destroy the evidence by washing the bus and also asked his accomplices not to talk about the incident. He parked the bus at RK Puram and later took it to its owner in Noida.



It was reportedly based on Ram Singh's confession that the police were able to arrest the others involved in the case, including his brother.



Ram Singh, with the four others, were charged with murder, gangrape, attempt to murder, kidnapping, unnatural offences, dacoity, hurting in committing robbery, destruction of evidence, criminal conspiracy and common intention under the Indian Penal Code.



Singh and the others in Tihar Jail had reportedly been assaulted by other inmates when they were taken in and had also been put on 'suicide watch'.



His background

Singh was a bus driver, despite an accident in 2009 that fractured his right arm so badly that doctors had to insert a rod to support it. He appeared on a reality television show in a compensation dispute with a bus owner, who in turn accused Singh of "drunken, negligent and rash driving".



Singh's neighbours describe him as a heavy drinker with a bad temper. One young woman said he used to get embroiled in violent rows and a relative recalled a physical altercation with her husband.



A Mail Today report  documents Singh as being a 'muscleman' in the Ravi Dass camp area of RK Puram in Delhi, a pocket of shanties in an otherwise upper middle class neighbourhood. Known for his drunken brawls in the neighbourhood, he had even reportedly eloped with a married woman, only to return after she passed away.



However, his parents had tried to justify their son's involvement in the heinous crime.



"They (Ram Singh and Mukesh) were not like this. In 20 years, they have never committed a crime. They must have been in bad company. As regards alcohol, that's common among drivers," Mangi Lal, the father of two of the accused, was quoted as saying in this Firstpost report.



Ram Singh had pleaded not guilty to the charges against him.



His death

Ram Singh died inside Tihar jail on 10 March. Prison authorities say he committed suicide using the clothes he was wearing to hang himself. The DG Prisons confirmed to CNN-IBN that Ram Singh committed suicide. However a magisterial inquiry has been launched into the incident, which is likely to impact the course of the trial. The death is also being seen as a major embarrassment to the Delhi police and Tihar jail officials.

Manipur: Parents of alleged rapist filed case against victim's parents

Imphal, January 31, 2013 [NE HELPLINE] ---  The parents of the rapist of the scheduled caste minor girl of Kakching have falsely filed a case against the victim's parents. North East Support Centre & Helpline submitted a memorandum to the National Commission for Women and National Commission for Scheduled Caste. Police are yet to arrest the culprits.

Ms Geeta (name changed) 17 years old, a student of Class XI, studying at Shillong was kidnapped by Yengkokpam Prameshwor Singh about 19 years old S/o Yengkokpam Rameshwor Singh of Charangpat Mamang Leikai, Thoubal district, kidnapped with three men in a red Maruti van. She was raped inside the vehicle and forced her to accept as eloped with her consent by the family members of the rapist.

A case of kidnapping, seducing and raping a minor girl is registered at Kakching Police Station under section 366/376/342/34 of IPC and 3(1)(XII) of SC/ST Prevention of Atrocity Act 1989.

Kakching Police official told North East Support Centre & Helpline that the parents of the rapist have filed a court case against the parents of the victim.

"This is unacceptable and an attempt to mislead the court and to harass and humiliate to the victim and her parents. The parents of the rapist should also be punished for false allegation and supporting the rapist" says Madhu Chandra, Spokesperson of NE Helpline.

Having learnt the seriousness of the matter, Core Team of North East Support Centre & Helpline has resolved to take help from Women Commissions. 

Memorandums have been submitted to the National Commission for Women and National Commission for Scheduled Caste. 

A delegation led by Mr Madhu Chandra and Rev. N. Debendra Singh, Member of Manipur State Minorities Commission will meet the Chairperson of Manipur State Commission for Women tomorrow.

North East Support Centre & Helpline demanded National Commission for Women and National Commission for Scheduled Caste to intervene the matter and ensure justice to the victim and punished the rapists and other involved in the crime.

Memorandums also include the demand for compensation to the rape victim as per the SC/ST Prevention of Atrocity Rule (Revised) 2011 and Supreme Court Directive of Rape Victim Scheme 2010, which amount Rs 1,20,000 (One lakh twenty thousand) from SC/ST POA Revised Rule 2011 and Rs 2,00,000 (Two Lakh) from Supreme Court's Directive Rape Victim Scheme.

The matter of crime against women in Manipur, Madhu Chandra, says, "Manipur Police should not allow Manipur to become like Delhi, in dealing the crimes against women. Delhi police used to deny and delay in registering and taking action for the crimes against North East women and as result, the crimes against the people from North East India increased. So shall not be the same in Manipur."

HAVE YOU SEEN THIS MAN? WANTED FOR RAPE & MURDER

New Delhi, Jan 2, 2013 [NDTV] --- When she was on her way home in Pune from the IT company where she worked, Nayana Pujari was raped and murdered, allegedly by four men. 

She was traveling in a car owned by her company.  The driver and a security guard assigned to escort her home were arrested, along with two friends.

Ms Pujari was 27 when she was killed in 2009.  Her husband, Abhijit, asked for a fast-tracked trial for his wife's case, but his petition was rejected by the Maharashtra Home department.

In September 2011, when he was brought to the Sassoon Hospital for a medical check-up, the cab driver, Yogesh Raut, escaped. He didn't have to try hard. He said he wanted to use the toilet.  A policeman removed his handcuffs and he was allowed to wander away unsupervised. 

The escape paralysed the case.  Mr Raut has still not been caught. Police sources say that in narco-analysis tests conducted on him, he allegedly referred to having raped another girl.

Supreme Court freeds 3 gang rapists after they agreed to compensate victim

New Delhi, Feb 22 2011 [INDIAN EXPRESS] --- In an unusual order, the Supreme Court let off three gang rapists after they claimed a 'compromise formula' with the victim and agreed to pay her a fine of Rs 50,000 each for their offence.

A bench of justices Markandeya Katju and Gyan Sudha Mishra reduced to three and half years the 10-year sentence awarded to three gang rapists who took the plea that both the convicts and the victim were now happily married to different people and "wanted to live peacefully."

Under Section 376(G) of the IPC, the minimum sentence to the gang rapists is 10 years, which may extend even to life imprisonment.

Though Justice Gyan Sudha Mishra was not initially inclined to compound (close the case by way of fine)the matter as it was not a compoundable offence, the apex court later relented and agreed to let them off provided the convicts paid Rs 50,000 each to the victim.

The apex court ordered that " the amount shall be paid to the victim within three months", failing which the same shall be recovered under the Land Revenue Act from the trio and paid to the victim.

In this case, the convicts Baldev Singh, Gurmail Singh and Hardeep Singh, all said to be agricultural farmers, had gangraped the victim in Punjab's Ludhiana district on March 5, 1997.

The sessions court had awarded 10 years imprisonment to the convicts.

The Punjab and Haryana High Court had dismissed the convicts' appeal, following which they appealed in the apex court.
