THE recent conviction of six pastors and an accomplice in Madhya Pradesh’s Dindori district, who were sentenced to five years of rigorous imprisonment, marks a deeply troubling moment for religious freedom in India. The men were arrested in April 2024 following a complaint filed by an uninvited neighbour during a private gathering held for a child’s fifth birthday. Local authorities subsequently charged them under the state’s stringent anti-conversion legislation, alleging the use of hate speech, material inducements, and fraudulent tactics to allure villagers into changing their faith. However, the host of the event explicitly testified in court that no conversion or propaganda had taken place in his home. Across India, hundreds of Christian pastors, church leaders, and lay workers face arrest, prolonged detention, or criminal charges under these sweeping statutes every year with over 1,600 believers detained or arrested across the country in recent monitoring periods alone. This stark contradiction between local police actions and primary witness testimony raises fundamental questions about how evidence is evaluated and whether state machinery is being used to police private gatherings under the guise of public order.

India’s constitutional framework guarantees the fundamental right to freedom of conscience and religion under Article 25, which explicitly includes the freedom to profess, practise, and propagate one's religion. Freedom of belief is a cornerstone of a pluralistic democracy, intended to protect both individual choice and peaceful religious discourse. Yet, state-level anti-conversion statutes enacted across multiple states, including Odisha, Madhya Pradesh, Arunachal Pradesh, Chhattisgarh, Gujarat, Himachal Pradesh, Jharkhand, Uttarakhand, Uttar Pradesh, Haryana, Karnataka, and Rajasthan are increasingly used to criminalise routine religious practice and social fellowship. These persistent restrictions have severely damaged the nation’s international standing; global monitoring bodies rank India 12th on the World Watch List for Christian persecution, while the U.S. Commission on International Religious Freedom (USCIRF) consistently recommends designating India as a “Country of Particular Concern” for severe violations of religious freedom. Across these jurisdictions, ordinary Christian worshipers, local pastors, and missionary educators are wrongfully labelled as operatives of a covert conversion apparatus, turning ordinary community welfare activities, prayer meetings, or private celebrations into criminal acts.
This trend exposes a worrisome failure of governance that makes India’s proud claim of being the world’s largest democracy and a pluralistic, secular nation look increasingly like a sham in the eyes of the global community. Both the central government and state administrations, particularly in Madhya Pradesh where these arrests occurred, must be strongly criticized for fostering a climate where draconian legislation is easily weaponised against religious minorities. By allowing vague statutory language to override fundamental constitutional guarantees, authorities encourage vigilante interference and partisan police action. When state apparatuses prioritize partisan ideology over equal protection under the law, the secular fabric of the nation is severely weakened. The state must urgently reform these laws, restrain overzealous local enforcement, and ensure that the constitutional right to preach and practise faith without state harassment remains a reality for every citizen.
