Mizoram Church Leader's Committee requests Law Commission of India

To,

The Member Secretary

Law Commission of India

4th Floor, Lok Nayak Bhawan,

Khan Market. New Delhi 110003.

Subj:   Request to Rescind Processing Uniform Civil Code.

Sir/Madam,

In response to Public Notice issued on June 14, 2023, the Mizoram Church Leader’s Committee (M.K.H.C.) as stakeholder of the Uniform Civil Code places our views, concern and sincere request to rescind processing the Uniform Civil Code.

(1)     Mizoram by virtue of Memorandum of Settlement (Peace accord) is placed on the status that “Notwithstanding anything contained in the constitution, no act of Parliament in respect of:

(a)  Religion or social practises of the Mizo.

(b)  Mizo Customary Law or Procedure.

(c) Administration of Civil and Criminal Justice involving decisions according to Mizo customary Law.

(d) Ownership and transfer of Land shall apply to the State of Mizoram unless the Legislative Assembly of Mizoram by a resolution so decides.” The MKHC is on the opinion that this UCC shall not apply to the State of Mizoram unless the Assembly by a resolution so decides.

(2)     The MKHC by careful scanning of the content of UCC feels that UCC is detrimental to the unity in diversity of Indian culture, religions and customs which our fore runners have dearly hold and cherished.

(3)     UCC is undeniably undermining the rights and privileges of minority enshrined in Constitution Article 371(G).

(4)     UCC could be an instrument of oppression and assimilation of the minority communities and religious bodies in our land.

Therefore, taking above few points into consideration, the Mizoram Church Leader’s Committee does not accept the Uniform Civil Code as it is and strongly condemns it. And so, we strongly appeal to you that the efforts made to impose the UCC should be suspended, and the proposal to introduce this code be rescinded.

Sincerely,

 (LALNILAWMA COLNEY)            (REV. DR. CHAWNGHMINGLIANA)
