ATRPFM submit an ultimatum to VM and Governor

 

Imphal, Dec 28, 2020 (UNA): The All Tribals' Rights Protection Forum Manipur (ATRPFM) submitted an ultimatum to the Chief Minister and Governor of Manipur on the subject ultimatum in the matter pertaining to ADC Election in respect of Manipur regarding on the three matters namely, to comply with the order dated 18-12-2020 passed by the High Court of Manipur in W.P(C) No.647 of 2020 thereby suspended the impugned order dated 30-11-2020 of supersession issued by Additional Chief Secretary (TA & Hills) in the matter pertaining to conduct of ADC Election and set aside the same on the ground of contravention of the provisions of ADC Act 1971 and its rules made thereunder; to follow the order dated 05-05-2015 issued by Principal Secretary (Tribal Affairs, Hills, SC), Govt. of Manipur as a binding precedents/conventions and let the Chairmen of ADCs to continue as the Caretaker Chairmen during the suspension period and restore their positions as Joint Signatories of the Bank Account for financial transactions and to issue notification for elections to ADCs and conduct the elections within 5th January, 2021 tailing which we shall be in painful necessity to impose Bandh on National Highways from 6th January, 2021 in collaboration with Tribal CSOs and the public. Alternatively, extend the term of office of the ADCs till the actual election is not conducted.

 

The ultimatum issued by ATRPFM signed by its president Joseph Rongmei stated that the term of office of the ADC members has been expired in the month of May

2020 as per the Section 13 of the Act, 1971 and the notification for election or reconstitution of ADCs shall be issued before the expiry of the term. However, the state Government extended the term till November 30, 2020 without reasonable ground of administrative difficulties.

 

Stated that the Hill Areas Committee (HAC) recommended for conducting the election on time and not to extend the term further However, the State Government issued a supersession order without taking into consideration the views and recommendation of HAC. 

The said order of supersession contravenes Section 47 of the Act, 1971 as the report from the Deputy Commissioner was not called for and there is no expiry date of supersession and the provisions under Sub Sections of Section 47 cannot be invoked as there are no grounds. That the Principal Secretary (Tribal Affairs, Hills, SC), Govt of Manipur issued an order dated 05-05-2015 thereby mandated the Chairmen of the ADCs to continue and serve as the caretaker chairmen during the conduct and till the completion of ADC elections 2015 of which the State Government will have to follow as a binding precedents/conventions, said the ultimatum. 

 

And the State Government cannot remove the Chairmen from the Joint Signatories as there are no statutory provisions to do so. As per Section 43 of the Act, all money received by the District Councils shall be held by the District Councils in Trust' and no other authority is competent to replace the signatories of the Chairmen from their Bank Accounts. The Chairmen of ADCs shall remain as Joint Signatories of the Bank Accounts for financial transactions.

 

That, the Hon'ble High Court of Manipur was pleased to pass an order in W.P(C) No.647 of 2020 thereby put the impugned order dated 30-11-2020 of supersession in suspension on the ground that the State Government issued the impugned order in total disregard and disobedience of the court order of November 27, 2020. It was observed by the court that once and order has been passed by the court, it will have to be honoured and complied with, if no appeal is preferred against it.

 

In the above-mentioned facts and circumstances, it is demanded to take prompt necessary action and direct the state government and the department concerned to comply with the court's ordera nd set aside the impugned order dated 30-11-2020; follow the order dated 05-05-2015 Principal Secretary (Tribal Affairs, Hills, SC), Govt. of Manipur as binding precedents/conventions; issue notification for elections to ADCs and conduct the elections within 5th January, 2021, failing which we shall be in painful necessity to impose bandh in National Highways from 7:00 am of 6 January, 2021 for 48 hours or extend the term of office of the ADCs till the actual election is conducted, whichever is preferable; make the Chairmen of ADCs to continue as the Caretaker Chairmen during the suspension period and restore their positions as Joint signatories of the bank account for financial transactions.

Final Pact should not affect Kuki areas: KIM

Imphal, Dec. 28, 2020 (UNA): The Kuki Inpi Manipur (KIM) submitted a memorandum to Union Home Minister Amit Shah on Monday during his visit to Imphal demanding exclusion of Kuki inhabited areas in the final solution to the Naga peace talks. 

 

The memorandum stated that the issue of Naga integration has caused fear in the minds of the Kukis residing in Chandel, Tengnoupal, Kangpokpi, Churachandpur, Pherzawl and some parts of Tamenglong, Ukhrul and Senapati districts.

 

Appealing the Union Home Minister to settle the "NSCN-IM's criminal acts of murdering more than one thousand innocent Kukis including children, uprooting of three hundreds sixty villages and seizing their ancestral land and displacing of over ten thousands Kuki people", KIM said that any solution to the Naga issue without legal settlement of the Kuki issue will sow seeds of social and political upheaval in the region, it added.

Sesei Zou have been targeted and magligned by some valley-based civil bodies: United Zou Organization

The United Zou Organization (UZO), while welcoming the historic judgement on the 17th December, 2020 regarding the multi crore drug case after two and half year, is appalled to see some section of student bodies and civil organizations raising 'suspicion of serious lapses' in the prosecution of the case. UZO has been a staunch
supporter of 'War on Drugs' campaign and will always be in the days to come.

        There have been multiple high profile drug seizures in Manipur including the present case. But, none have been targeted as much as the case involving a minority tribe leader Lhukhosei Zou. Neither student organization nor civil society has enquired or take interest in the other multi crore drug cases in the state. It is worth reckoning if these organizations are behind the demand for payment of Four Crores in Indian Rupees from Lhukhosei Zou while in NAB custody but which was denied or if they are not interested in the other drug cases because they belonged to larger ethnic groups in the state.

     The organization would like to remind the different CSOs that the then ASP of NAB Th. Brinda demanded Rs. 30 lakhs from Haji Masle of Lilong, Thoubal for his release from the custody of NAB. She was also found taking undue advantage of her position as a police officer and was implicated in a corruption case as an accuse in special trial case No. 13 of 2020 at Special Court, ND & PS, Thoubal. Contempt of court case and defamation case are also still pending against her in session and high court.

  Mr. Babloo Loitongbam and his cohort should also demand an appeal to the cases against Th. Brinda. Why should respectable citizens who are waging war against corruption, drugs and illicit trafficking of drugs remain silent on Ms. Brinda but make a hue and cry on Mr. Lhukhosei Zou? Some valley based CSOs have maligned the reputation of Lhukhosei Zou multiple times whereby his image is adversely affected. The UZO would like to reiterate that no individual or organization, be it a student organization or civil society, is above the law.

        It is an earnest appeal to the people who are trying to ransom justice at the cost of someone's dignity not to interfere in the functions of the judiciary and respect the judicial system of the country.

Manipur Govt served notice, Order superseding ADCs suspended

IMPHAL, Dec. 11, 2020 (UNA): The high court of Manipur has suspended the state Government's impugned order of November 30, 2020 which superseded the six ADCs and appointed the respective Deputy Commissioners to exercise all powers and duties conferred and imposed on the council under the Manipur (Hill areas) District Council Act 1971 without due process of law.

 

The Court also served notice to the state Government which is returnable by December 16, 2020.

 

The Court passed the order based on a Writ petition (C) No. 647 of 2020 filed by one Lunthang Haokip and others as petitioner. Hearing of the case was held on Wednesday via video conferencing.

The petitioner prayed for issuing a writ of certiorari or any other appropriate writ to quash the government order issued on November 30, 2020, alleging that the order was issued violating the order passed by the High Court on November 27, 2020.

 

After perusal of the para (5) of the court order of November 27, the high court asked the AG appearing for the state government as to whether any order had been passed by the state government on or before 30-11-2020 extending the term of ADCs till the next date i.e December 4, 2020, to which the AG replied in the negative stating that no such order had been passed as no such order was required to be passed by the state government stating that the term of ADCs ought to continue automatically.

However, on perusal of the impugned order of November 30, it is evident that it is nowhere mentioned therein that the said order has been issued by the state government in compliance with the order passed by the Court on November 27.

 Instead of complying with the court order or preferring an appeal before the appellate court questioning the high court's order, state government issued the impugned order superseding the six ADCs, the extension of which term had to expire on November 30, the court said.

The Court observed that the state government issued the impugned order in total disregard and disobedience of the Court order of November 27.

 

The court said, in the absence of the court's interference, it is open to the state government to issue any order, at its wisdom, in accordance with the law. Once an order has been passed by the court, it will have to be honoured and complied with, if no appeal is preferred against it".
