"Voices from the Ashes: Why KIM's Appeal to MLAs Is a Stand for Justice, Not a Constitutional Breach"

In support of the Kuki Inpi Manipur (KIM), this response seeks to clarify and defend the intent behind the memorandum issued on 05/07/2025, which urged Kuki-Zo MLAs to abstain from participating in the formation of any government in Manipur until a just and honourable political resolution is achieved. The rebuttal by Thadou Herald is misleading and reflects a narrow legalistic perspective on a deeply rooted political and humanitarian crisis.

1. Moral Authority in Times of Crisis

While KIM is not a constitutional body, it draws its moral, cultural, and customary legitimacy from the collective will of the Kuki-Zo people. In times of ethnic conflict, civil society bodies have historically played a critical role in shaping the political conscience and protecting community interests. The memorandum was not a coercive diktat but a political appeal for solidarity in the face of ethnic cleansing, mass displacement, and systematic violence endured by the Kuki-Zo community since May 2023.

2. No Violation of the Constitution

KIM's memorandum does not forcibly bar MLAs from performing their duties. It merely urges them to refrain from legitimising a government process that has failed to uphold justice for the community. This is a legitimate exercise of community agency and political expression under Article 19(1)(c) of the Constitution, not a violation of democratic norms.

3. Democracy is Not Blind Majoritarianism

While MLAs are elected to fulfil constitutional responsibilities, they are also accountable to the moral will of their people. The call to abstain from government formation arises not from political sabotage, but from the recognition that participating in the current process would mean endorsing a government under whose watch over 300 Kuki-Zo villages and churches have been destroyed, over 200 Kuki-Zo brutally killed and more than 60,000 people displaced. True democratic representation includes standing with one's people during their darkest hours.

4. Cultural Bodies Are Integral to Indigenous Politics

In tribal societies, traditional institutions like KIM are not apolitical spectators. They are guardians of identity, justice, and survival, especially when the state fails to protect its marginalised communities. KIM has every right to express its political stance on behalf of the Kuki-Zo people. Dismissing its relevance as "non-statutory" ignores the ground realities of indigenous governance and representation.

5. Misuse of Legal Language by Thadou Herald

The invocation of laws related to criminal intimidation or sedition by the Thadou Herald is an overreach and misinterpretation. KIM has neither threatened violence nor coerced any MLA. It has exercised its constitutional right to free expression and peaceful political advocacy. In contrast, attempts to label such expression as unlawful can themselves be viewed as undemocratic and suppressive.

6. Call for Unity, Not Division

At a time when the Kuki-Zo people are struggling for survival and justice, internal disunity only deepens wounds. The Thadou Herald's confrontational tone against a collective community resolution only serves to divide, rather than heal. What is needed now is solidarity rooted in justice, not constitutional literalism used to delegitimise genuine grievances.

Rebuttal to Kuki Inpi Manipur's Unconstitutional Office Memorandum Dated 05/07/2025

The Thadou Herald, on behalf of the Thadou people, hereby issues this rebuttal in response to the Office Memorandum dated 05/07/2025 issued by Kuki Inpi Manipur (KIM), which resolved that no Kuki or Zo MLA shall participate in the formation of a popular government in Manipur.

1.  Violation of Constitutional Duties and Democratic Mandate: Under Article 164(2) and the Tenth Schedule of the Constitution of India, elected representatives (MLAs) have an obligation to fulfil their mandate by participating in government formation to ensure governance and constitutional continuity. Any directive preventing MLAs from doing so undermines democratic processes and violates the collective will of their electorate.

2.  KIM Has No Legal or Statutory Authority Over MLAs: Kuki Inpi Manipur is a non-constitutional civil society organisation without any statutory recognition under Indian law. Its issuance of binding resolutions or diktats upon MLAs infringes upon the autonomy of constitutional offices and amounts to unlawful coercion or intimidation under:

1. BNS – Criminal intimidation

2. Representation of the People Act, 1951

3.  Fundamental Rights Violation: The KIM resolution infringes upon Article 14 (Equality before law), Article 19(1)(a) (Freedom of speech and expression), and Article 21 (Right to life with dignity) by threatening MLAs with community-backed social boycott or coercion, thereby suppressing their fundamental rights.

4.  Overstepping Jurisdiction: KIM's authority is limited only to "Any Kuki tribes" ST category for cultural advisory roles, and does not extend to political diktats, especially against independent constitutional offices like MLAs. Any attempt to enforce such diktats is legally void ab initio.

5.  Threat to Public Order and Governance Stability: By preventing elected MLAs from performing constitutional duties, KIM is abetting constitutional crisis, breakdown of governance, and denial of public services, potentially inviting legal action under relevant BNS sections if it incites violence or public disorder.

6. Unlawful Interference in Legislative Functioning: No civil body can bar MLAs from exercising their constitutional functions under Article 208, which guarantees freedom within the legislative domain.

Thadou Herald asserts:

1. MLAs are constitutionally bound to participate in the formation of a popular government.

2. KIM has no legal mandate to issue binding resolutions on the political participation of MLAs.

3. Any further intimidation of MLAs by KIM or its affiliates will be liable for legal proceedings under criminal intimidation, sedition (if inciting disaffection against the Constitution), and violation of fundamental rights.

We demand that Kuki Inpi Manipur:

1. Withdraw its unconstitutional resolution immediately.

2. Cease all forms of intimidation or coercion against elected representatives.

3. Restrict its activities strictly to cultural and community advisory roles within the "Any Kuki Tribes" jurisdiction.

4. Respect the fundamental and constitutional rights of other indigenous communities, including Thadou.

India is governed by the Constitution, rule of law, and democratic values, not by non-statutory organisations seeking to usurp constitutional processes through coercive or intimidatory resolutions.

2. J.H. Hutton (Census of India, 1931) and R. Brown (Statistical Account of Manipur,1873) classified the Kukis as Hill Tribe of Manipur.

3. There is no reference in British official documents that describe the Kukis in Manipur as ALIENS and REFUGEES as manipulated by some sections of Kacha Nagas.

Zomi Council Urges Caution in SoO Camp Reductions

Lamka, July 6, 2025: The Zomi Council has appealed to the Government of India for a sensible and security-conscious approach to the extension of the Suspension of Operations (SoO) agreement with hill-based groups. The appeal follows mounting pressure on the United People's Front (UPF-Zomi) to shut down at least two of the three designated SoO camps—Camp Muvanlai, Mt Sinai, and Phaiba—situated in Zomi-majority areas, far from the volatile Imphal valley.

Following internal consultations, the Zomi Council emphasised the need to keep all three camps operational to ensure effective border management along Mizoram and the Myanmar border. It warned that reducing the camps could lead to security vacuums, enabling non-SoO armed groups and secessionist elements to exploit the region and disturb public peace.

The Council underscored the positive role of SoO groups that have supported dialogue and peace, urging the government to base decisions on logical and reasonable grounds rather than disruptive interference.

While suggesting that only uncooperative outfits be considered for camp reduction, the Zomi Council urged the Ministry of Home Affairs to expedite the SoO agreement extension in the broader interest of public safety and regional stability.

Reaffirming its commitment to peace, the Council expressed readiness to assist in any future dialogue process.

(L) Dr. Nehginpao's Citizenship

Dr Nehginpao kipgen was an American Citizen who held a US passport. He was the founder & director of CSEAS later renamed Dr Nehginpao kipgen Centre for South east Asian studies in honour of his legacy.

Contrary to the Misinformed & ignorant slander by the deposed & disgraced CM Biren singh & his sycophantic entourage, he did not enter India illegally. Following the "8888 uprising" & subsequent brutal & bloody Military Repression in Myanmar,1988 by the military dictator General Ne win which culminated in the death of thousands of activists & Grave human rights violations against Minorities,India swiftly & boldly aligned itself firmly with the Pro Democracy Camps, it fiercely criticized the Junta,called for "Complete disengagement" with the military Junta,provided political & material support to pro democratic activists in yangon & India distinguished itself as the first country neighbouring Myanmar to overtly back the Democratic movement & offer sanctuary to Dr Nehginpao's family & hundreds of other Pro Democratic activists allowing them to live,work,study & even settle in India without any pressure on repatriation.

Furthermore,as per the resolution adopted by the General Assembly (107 Plenary meeting, 13 September 2007),6/295 United Nations Declaration on the Rights of Indigenous Peoples,A/36 states that indigenous peoples,in particular those divided by international borders,have the right to maintain & develop contacts,relations & cooperation, including activities for spiritual, cultural,political,economic & social purposes,with their own members as well as other peoples across international borders.

Birthplace:

Dr Nehginpao's birthplace Teijang, is a village along the Indo-Myanmar border,barely 1.7km from India. Teijang,Sagiang region is part of the kabaw valley. How then, can Meiteis lay claim to Kabaw Valley as an inseparable part of Manipur,while simultaneously branding Dr. Nehginpao,a native of Kabaw Valley,a foreigner? If nativity in Kabaw Valley confers foreign status,then it logically follows that Kabaw valley itself is undisputably a foreign territory & therefore Meiteis should forfeit all claims to it & relinquish any aspirations of ever reclaiming it.

Myanmar was incorporated into British India as a province from 1824-1937 therefore, His parents/grandparents were British subjects by virtue of their birth in British India,as were all Indians prior to 1947. The notion of Indian citizenship,as a distinct legal identity in its modern legal sense, only emerged after independence with the passage of the Indian Citizenship Act.

His Education:

With the approval of Indian Govt,he completed his schooling in Manipur through higher secondary education.  His academic excellence was recognized with the award of the highly prestigious & fully funded Fulbright Scholarship,the most competitive & prestigious international academic awards funded by the US State Department which facilitated his advanced studies in the United States & culminated in his acquisition of American citizenship.

His Academic legacy:

Upon returning to India,He founded the Centre for South East Asian Studies.

He served as the “country expert for Myanmar” for varieties of democracy (V-Dem).

He has published four single-authored books in Routledge,Oxford University 

Press & Ruby Routledge, he had signed a contract for his fifth book with Routledge & his 2 articles had been accepted for publication in SCOPUS-indexed journals before he succumbed to Covid.

He published 21 peer-reviewed academic articles.

He has also published over 190 articles in various leading international news & magazines in 5 Continents, spanning over 30 countries.

His Death:

He succumbed to COVID-19 in 2021. Despite the shift in labeling Dr. Nehginpao as an illegal immigrant,his remains were respectfully repatriated to Kangpokpi for burial,following the necessary approvals from the very same Biren Singh govt,which issued a No Objection Certificate.

Kuki Inpi Manipur Issues Unanimous Political Stand Against Participation in Manipur Government Formation

Lamka, July 5, 2025 — The Kuki Inpi Manipur (KIM), the apex body of the Kuki tribes, has issued an official memorandum declaring a unanimous political resolution regarding the role of Kuki-Zo MLAs in the formation of a new government in Manipur. The resolution was adopted during a joint meeting held on July 4, 2025, at the KIM Secretariat Conference Hall in Bijang, Lamka.

The meeting was attended by representatives from KIM's federating units, including the Kuki Students' Organisation-General Headquarters (KSO-GHQ), Kuki Khanglai Lawmpi-General Headquarters (KKL-GHQ), Kuki Christian Leaders' Forum (KCLF), Kuki Women's Union-General Headquarters (KWU-GHQ), Kuki Women Organisation for Human Rights-General Headquarters (KWOHR-GHQ), Kuki Chiefs' Association-Manipur (KCA-M), and other district units and department heads under KIM.

Following thorough deliberation, two key resolutions were unanimously adopted:

1. No Kuki-Zo MLA shall participate in the formation of a new Popular Government in the State of Manipur.

2. The Kuki-Zo community shall not, under any circumstances, compromise on its ancestral land, culture, identity, and political, social, and economic rights.

KIM stated that the resolution reflects the collective political will and aspiration of the Kuki-Zo people. It is binding on all representatives and community organisations within the Kuki-Zo fold.

"All concerned are hereby advised to adhere strictly to this resolution in letter and spirit," the memorandum emphasized.

The resolution was signed and issued by Khaikhohauh Gangte, General Secretary of Kuki Inpi Manipur, in the interest of the people.

Copies of the memorandum have been sent to the Kuki-Zo Council (KZC), United People's Front/Kuki National Organisation (UPF/KNO), Forum of 10 Kuki-Zo MLAs, all federating units and district bodies of Kuki Inpi, and relevant community and civil society organisations.

This rejoinder is issued by the Federal Council of 4 (FCO4) such as the Kuki Reformation Forum (KReF), the World Kuki-Zo Intellectual Council (WKZIC-GHQ), the Thadou Tribe Council (TTC-GHQ) and the Kuki Youth Forum (KYF) in response to the  so called Indigeneous Peoples’ Forum Manipur (IPFM), the Thadou Inpi Manipur (TIM), the Meitei Alliance (MA) and the Foothills Naga Co-ordination Committee (FNCC)’s Letter Vide. Ref. IPFM/ MA/TIM/SOO/2025/07/3MM, dated, the 03/07/2025, addressed to Shri. Amit Shah, Hon’ble Union Minister, under the subject: “Request for non-renewable of flawed and violated Suspension of Operation  (SoO) Agreements with Armed Militant Groups Responsible for the Law-and-Order Crisis in Manipur”, as under.

That, the so called IPFM, TIM, MA and FNCC must know that the “Crisis in Manipur” has been the premeditated calculated plan of the Manipur State Government with the following Political developments  in Manipur w.e.f.  February 2023 till the outbreak of current conflict on 3rd May  as under.

i) Formations of Arambai Tenggol (AT) Units in every Meitei locality for War: 2022 onwards  

ii) Indiscrimate Arresting of many Kukis who voiced out GoM’s Communal Governance: 2022 whole year

iii) 100 Acres of Land Acquisitions at Songpi Village Churachandpur for Sector Headquarter and Battallion: 9th February 2023.

iv) K. Songjang Kuki Village Eviction and Demolitions: 20 February 2023.

v) 3 Kuki Churches of  Tribal Colony, Imphal East Eviction & Demolition: 11 April, 2023.

vi) Supreme Court Order for Meitei ST Status to be granted: May 2023

vii) Collection of Licence Guns from all Kuki Districts and Areas: March-April 2023

viii) Blockade upon Kukis by Meiteis from evening of 2nd May: 2nd May 2023

ix) Burning of Anglo-Kuki War Centenary Gate by Meiteis: 3rd May 2023

That the SoO groups are under the Indian Constitutional provisions with the Government of India and the Indian Army from 2008 to the present, working hand to hand with the Government of India, MHA and Indian Army, whom the Central Forces such as AR/BSF/CRPF/Para Regt.etc knew minutely about the SoO groups whom GoI/MHA/CBI/NIA got upto date informations, and unsolicited Orgns. such as IPFM/ TIM/ MA/ FNCC should not meddle for their Anti-Kuki movements and activities.

It must also be noted by IPFM/TIM/MA/FNCC that a “Rumour of Kukis Raping a Meitei Nurse” in Churachandpur was spreaded by Meiteis (In reality no one was raped clarified by the family members)  who hunted Kukis like wild animals on roadsides, markets and Galis in and around Greater Imphal Valley, killed in cold blood 226 Kukis mostly Women, burning down 200 Kuki Villages and 254 Kuki Churches out of 365, through the 6,000 Arms and 6,00,000 Ammunitions given out freely to AT radicals from the Manipur State Armoury by the Manipur Government. Almost all the 30,000 Manipur State Forces belonging to Meitei community such as IRB/ Manipur Police/ Police Commando and Meitei CF Officers in AR and BSF too sided the Meiteis in Sugnu, Moreh and other places by deploying Mortars and Caspers.
